Composition

The LAB was originally made up of Council appointed Chiefs from each of the original signatory First Nations. In 2002 Canada indicated its support to include up to 75 new First Nations. Faced with the possiblity of having a board comprised of 89 representatives (75+14), the Lands Advisory Board resolved in 2003 to be composed of the following:

It is intended that the future LAB composition, effective as of the 2004 LAB Annual Meeting, will consist of a maximum of ten (10) members. Seven members of the LAB were appointed in 2003.

The following procedure is required to appoint the additional members in 2004:

  • The Councils of those First Nations in British Columbia that have ratified the Framework Agreement may appoint one additional member to serve from the end of the 2004 LAB Annual Meeting until the end of the 2007 LAB Annual Meeting.
  • The Councils of those First Nations in Alberta, Saskatchewan and Manitoba that have ratified the Framework Agreement may appoint one additional member to serve from the end of the 2004 LAB Annual Meeting until the end of the 2007 LAB Annual Meeting.
  • The Councils of those First Nations in Ontario, Quebec and Atlantic Canada that have ratified the Framework Agreement may appoint one additional member to serve from the end of the 2004 LAB Annual Meeting until the end of the 2007 LAB Annual Meeting.

Terms of Office

All additional members of the LAB, appointed to serve in 2004, will be appointed for three year terms of office. As the terms of office of the other members of the LAB expire, all subsequent appointments to the LAB will be for three years from the date of expiry of the initial term of office. The appointing body may re-appoint LAB members whose terms have expired.

Regional Representation

Subsequent to the 2004 LAB Annual Meeting, all members, excluding the LAB Chair, shall be deemed to have been appointed as follows:

  • three (3) members appointed by the Councils of those First Nations in British Columbia that have ratified the Framework Agreement;
  • three (3) members appointed by the Councils of those First Nations in Alberta, Saskatchewan and Manitoba that have ratified the Framework Agreement;
  • three (3) members appointed by the Councils of those First Nations in Ontario, Quebec and Atlantic Canada that have ratified the Framework Agreement; and

Filling Vacancies on the LAB

Should any position on the LAB become vacant, the body that appointed the vacated position may appoint another individual to serve out the lesser of:

  • the balance of the term of office of that position; or three years.
